NOTE:  Items on the agenda may be taken out of order; combined with other items; removed from the agenda; moved to the agenda of another meeting; moved to or from the Consent section; or may be voted on in a block.  Items with a specific time designation will not be heard prior to the stated time, but may be heard later.  Items listed in the Consent section of the agenda are voted on as a block and will not be read or considered separately unless removed from the Consent section.  The Board of County Commissioners may take breaks approximately every 90 minutes.

Time Limits.  Public comments are welcomed during the Public Comment periods for all matters, whether listed on the agenda or not, and are limited to three minutes per person.  Additionally, public comment of three minutes per person will be heard during individually numbered items on the agenda.  Persons are invited to submit comments in writing on the agenda items and/or attend and make comment on that item at the Commission meeting.  Persons may not allocate unused time to other speakers.  To preserve time and increase efficiency representatives of recognized groups may be given more than 3 minutes as determined by the presiding officer.

 

Forum Restrictions and Orderly Conduct of Business.  The Board of County Commissioners conducts the business of Washoe County and its citizens during its meetings.  The presiding officer may order the removal of any person whose statement or other conduct disrupts the orderly, efficient or safe conduct of the meeting.  Warnings against disruptive conduct may or may not be given prior to removal.  The viewpoint of a speaker will not be restricted, but reasonable restrictions may be imposed upon the time, place and manner of speech.  Irrelevant and unduly repetitious statements and personal attacks which antagonize or incite others are examples of speech that may be reasonably limited.

 

Responses to Public Comments.  The County Commission can deliberate or take action only if a matter has been listed on an agenda properly posted prior to the meeting.  During the public comment period, speakers may address matters listed or not listed on the published agenda.  The Open Meeting Law does not expressly prohibit responses to public comments by the Commission.  However, responses from Commissioners to unlisted public comment topics could become deliberation on a matter without notice to the public.  On the advice of legal counsel and to ensure the public has notice of all matters the Commission will consider, Commissioners may choose not to respond to public comments, except to correct factual inaccuracies, ask for County staff action or to ask that a matter be listed on a future agenda.  The Commission may do this either during the public comment item or during the following item:  “*Commissioners’/Manager’s Announcements, Requests for Information, Topics for Future Agendas and Statements Relating to Items Not on the Agenda”.

5.      Consent

 

5.A.      Approval of minutes for the Board of County Commissioner’s regular meeting of June 21, 2016.

             

5.B.      Approve amendments totaling an increase of [$20,025] in both revenue and expense to the FY17 Air Pollution Control Grant Program, IO 10021; and if approved direct the Comptroller’s office to make the appropriate budget amendments.  Health.  (All Commission Districts.)

 

5.C.      Approve roll change requests, pursuant to NRS 361.765 and/or NRS 361.768, for errors discovered for the 2012/2013, 2013/2014, 2014/2016, 2015/2016 secured and unsecured tax rolls and authorize Chair to execute the changes described in Exhibits A and B and direct the Washoe County Treasurer to correct the error(s). [cumulative amount of decrease $10,606.62].  Assessor.  (Parcels are in Commission Districts 1, 2, 3, 4, 5.)  

 

5.D.      Approve payments [totaling $11,417.78] to vendors for assistance of 88 victims of sexual assault and authorize Comptroller to process same.  NRS 217.310 requires payment by the County of total initial medical care of victims, regardless of cost, and of follow-up treatment [costs of up to $1,000] for victims, victim’s spouses and other eligible persons.  District Attorney.  (All Commission Districts.)  

 

5.E.       Acknowledge the Professional Services Agreement for medication assisted treatment services for Medication Assisted Treatment Court between the Second Judicial District Court and Quest Counseling and Consulting,[ in the amount of $156,154], retroactive from the period July 1, 2016 through June 30, 2017.  District Court.  (All Commission Districts.) 

 

5.F.       Approve a First Amendment to Lease Agreement between Washoe County and 865 Tahoe Boulevard Associates for continued occupancy of office space for the Incline Justice Court located at 865 Tahoe Boulevard, Incline Village, Nevada, for a 60 month term, effective October 1, 2016 through September 30, 2021 [$83,493.12 annually plus 3% annual increases in years 2017 and 2019].  Community Services.  (Commission District 1.)  

 

5.G.      Approve changes to position control for Fiscal Year 16/17 effective retroactive to July 1, 2016; and approve reclassification requests for: Outreach Specialist I/II, pay grades K/L, to a new job classification of Juvenile Services Case Manager I/II, pay grade K/L (Juvenile Services); Forensic Investigator II, pay grade L, to Criminalist II, pay grade NP (Sheriff’s Office); vacant Program Assistant, pay grade K, to Social Services Program Specialist, pay grade Q; vacant Senior Human Services Support Specialist, pay grade I, to Community Outreach Coordinator, pay grade N, and a vacant Human Services Support Specialist II, pay grade H, to Case Compliance Reviewer - CPS, pay grade Q; Foster Care Training and Support Specialist, pay grade P, to Mental Health Counselor II, pay grade P (Social Services); Community Outreach Coordinator, pay grade N, to Management Analyst, pay grade N (Manager’s Office) as evaluated by the Job Evaluation Committee. Net annual cost is zero due to other reductions incorporated in the Fiscal Year 16/17 budget.  Human Resources.  (All Commission Districts.)

 

5.H.      Approve Sheriff’s Security Agreement between Milthorpe Sports, LLC and the County of Washoe on behalf of Washoe County Sheriff’s Office to provide uniformed Deputy Sheriffs for security during the 2016 American Century Golf Tournament [estimated cost to be $50,000], for the retroactive period of July 19 through July 24, 2016.  Sheriff.  (All Commission Districts)

 

5.I.        Approve a grant award to support the Domestic Violence Compliance Court program, from the Nevada Office of the Attorney General to the Reno Justice Court [$35,000.00/25% in-kind match required], retroactive from July 1, 2016 to June, 30 2017; and direct the Comptroller to make the appropriate budget adjustments.  Reno Justice Court.  (All Commission Districts.)

5.J.1.    Approve the settlement of the claim Marvis Walton against Washoe County et al, for a total sum of $140,000 for all claims against all defendants.  (All Commission Districts.)  

 

5.J.2.    Approve Washoe County’s Indebtedness Report and accompanying schedules for fiscal year 2015/16.  (All Commission Districts.)  

 

              Social Services

 

5.K.1.   Approve expansion of the Crossroad program, specifically the Temporary Assistance to Displaced Seniors (TADS) population in collaboration with the Department of Health and Human Services, Aging and Disability Services Division by allowing Washoe County Department of Social Services to occupy space on the Sierra Regional Center campus located at 605 South 21st Street, Sparks, NV, in order to operate its Washoe County Senior Transitional Program with approximately 14 available beds; and authorize Director of Social Services, Amber Howell, to execute corresponding inter-local agreement.  (All Commission Districts.)  

 

5.K.2.   Approve staff to proceed with the selection of a building for use by the Child Protective Services as a family visitation center and authorize the Director of Social Services, Director of Community Services, and the District Attorney’s office to negotiate a potential acquisition; provide[up to $20,000] of a refundable earnest deposit for the building of interest; and if approved authorize the Director of Social Services to approve any due diligence needed including a Phase I environmental study, appraisal, and inspections necessary [up to $21,000 deposit plus Phase 1 not to exceed $41,000]; and if the acquisition is acceptable staff shall return to the Board of County Commissioners for review of the terms and final approval of the acquisition.  (All Commission Districts) 

 

5.K.3.   Approve a one-time payment and authorize the Purchasing and Contracts Manager to generate a Purchase Order in the amount of [$137,000] in FY17  to support an adoption awareness campaign in collaboration with Wolf Pack Sports Properties, LLC., to be funded by Federal and State grants.  (All Commission Districts).

5.L.1.   Approve Washoe County’s Debt Management Policy as of June 30, 2016.  (All Commission Districts.)

 

5.L.2.   Acknowledge Receipt of the Inventory Controls Audit Report from the Internal Audit Division.  (All Commission Districts.)

 

5.L.3.   Acknowledge an update to the Washoe County FY16-18 Strategic Plan, including mission, values and direction, strategic objectives and final report on goals and initiatives for Fiscal Year 2015-16.    (All Commission Districts.)

7.        Recommendation to approve the settlement of the claim Piotr Kubiczek against Washoe County et al, for [a total sum of $260,000] for all claims against all defendants.  Comptroller.  (All Commission Districts.)

 

8.        Recommendation to retroactively acknowledge the grant award from the State of Nevada, Administrative Office of the Courts to the Second Judicial District Court, [in the amount of $1,163,448 no match required], to support the Specialty Court programs, effective July 1, 2016 through June 30, 2017, and direct the Comptroller’s Office to make the necessary budget amendments.  District Court.  (All Commission Districts.)  

 

9.        Recommendation and possible action to approve the appointment of Charles Guffey to the Washoe County Open Space and Regional Parks Commission representing Commission District 1 to fill a term beginning on July 26, 2016, and ending on June 30, 2020, or until such time as a successor is appointed.  Community Services.  (Commission District 1.)  

 

10.      Recommendation to accept a Sub-grant Award from the State of Nevada Division of Child and Family Services [in the amount of $1,765,819] [$441,445 in-kind match required] for the Victims of Crime Act (VOCA) Program retroactively to July 1, 2016 through June 30, 2017;  authorize the creation of 1.0 FTE Victims Advocate, 1.0 FTE Human Services Program Supervisor, 1.0 FTE Program Assistant, and 1.0 FTE CPS Intake Screener funded 100% by the VOCA award in the [approximate annual amount of $440,686], direct the Human Resources Department to make the necessary staffing adjustments and initiate the recruitment process,  authorize the Department to execute the Sub-Grant Award and direct the Comptroller’s Office to make the necessary budget amendments.  Social Services.  (All Commission Districts.)

 

11.      Recommendation to authorize the Director of the Community Services Department to enter into all necessary agreements and construction contracts for the development and implementation of the Panther Drive Emergency Sanitary Sewer Project [not to exceed $600,000].  Community Services.  (Commission District 5.) 

 

12.      Recommendation and possible action to approve a Right of Entry Agreement between Washoe County and the City of Reno for the construction of a helipad by the Community Services Department to be used by the Washoe County Health District, Vector-Borne Diseases Program at Fire Station 12 in the South Meadows area.  Community Services.  (Commission District 2.) 

 

13.      Recommendation and possible action to introduce and conduct first reading of an ordinance amending Washoe County Code Chapter 110 (Development Code) to clarify when an accessory structure or use may be constructed on a parcel without an existing main structure or an existing principal use. The amendment focuses on circumstances where the subject parcel is adjacent to a parcel with an existing main structure or principal use and when both parcels are under the same ownership. The amendment includes updates to the following sections of the Development Code:  Article 306, Accessory Uses and Structures, Section 110.306.15, Main Structures Required – to identify the circumstances under which an accessory structure or use may be established on a parcel without an existing main structure or an existing principal use.  Article 410, Parking and Loading, Section 110.410.20, Location of Required Parking Spaces – to clarify that a dwelling’s required garage may only be located on an adjoining lot if it also meets the requirements of Section 110.306.15.  Article 902, Definitions, Section 110.902.15, General Definitions – to update definitions for “Detached accessory structure,” “Lot” and “Parcel of land” to better reflect the proposed code amendments identified above.  And, if supported, set the public hearing for second reading and possible adoption of the Ordinance for August 9, 2016.  Community Services.  (All Commission Districts.)

 

14.      Possible Closed Session for the purpose of discussing labor negotiations with Washoe County, Truckee Meadows Fire Protection District and/or Sierra Fire Protection District per NRS 288.220.
