NOTE:  Items on the agenda may be taken out of order; combined with other items; removed from the agenda; moved to the agenda of another meeting; moved to or from the Consent section; or may be voted on in a block.  Items with a specific time designation will not be heard prior to the stated time, but may be heard later.  Items listed in the Consent section of the agenda are voted on as a block and will not be read or considered separately unless removed from the Consent section.  The Board of County Commissioners may take short breaks approximately every 90 minutes.

Time Limits.  Public comments are welcomed during the Public Comment periods for all matters, whether listed on the agenda or not, and are limited to three minutes per person.  Additionally, public comment of three minutes per person will be heard during individually numbered items on the agenda.  Persons are invited to submit comments in writing on the agenda items and/or attend and make comment on that item at the Commission meeting.  Persons may not allocate unused time to other speakers.

 

Forum Restrictions and Orderly Conduct of Business.  The Board of County Commissioners conducts the business of Washoe County and its citizens during its meetings.  The presiding officer may order the removal of any person whose statement or other conduct disrupts the orderly, efficient or safe conduct of the meeting.  Warnings against disruptive comments or behavior may or may not be given prior to removal.  The viewpoint of a speaker will not be restricted, but reasonable restrictions may be imposed upon the time, place and manner of speech.  Irrelevant and unduly repetitious statements and personal attacks which antagonize or incite others are examples of speech that may be reasonably limited.

 

Responses to Public Comments.  The County Commission can deliberate or take action only if a matter has been listed on an agenda properly posted prior to the meeting.  During the public comment period, speakers may address matters listed or not listed on the published agenda.  The Open Meeting Law does not expressly prohibit responses to public comments by the Commission.  However, responses from Commissioners to unlisted public comment topics could become deliberation on a matter without notice to the public.  On the advice of legal counsel and to ensure the public has notice of all matters the Commission will consider, Commissioners may choose not to respond to public comments, except to correct factual inaccuracies, ask for County staff action or to ask that a matter be listed on a future agenda.  The Commission may do this either during the public comment item or during the following item:  “*Commissioners’/Manager’s Announcements, Requests for Information, Topics for Future Agendas and Statements Relating to Items Not on the Agenda”.

5.C.      Authorize Washoe County Treasurer to auction all newly delinquent lands held in trust for a total amount not less than the amount of the taxes, costs, penalties and interest legally chargeable against the property with the exception of those parcels listed on Exhibit “A” and approve and execute the Resolution Authorizing the Washoe County Treasurer to Transfer to Other Governmental Entities, Real Property held in Trust Due to Property Tax Delinquencies and Other Matters Properly Related Thereto.  Treasurer.  (All Commission Districts.)

5.D.1.    Approve an Agreement for Consulting Services between Washoe County and Carollo Engineers, Inc., commencing October 13, 2015 and ending July 31, 2016, to provide design engineering services for the South Truckee Meadows Water Reclamation Facility Chemical Storage Building Rehabilitation Phase 1 Project [$131,719].  (Commission District 2.)

 

5.D.2.    Approve a State of Nevada Importer and Wholesale Dealer of Wine, Liquor and Beer License for Andrew Humphriss, dba A&J Distributors, LLC, and if approved, authorize each Commissioner to sign the State of Nevada License Application for Importer and Wholesale Dealer of Wine, Liquor, and Beer with direction for the County Clerk to attest the license application.  (Commission District 2.)

 

5.D.3.    Approve Change Order #1 for the Building A – West End Remodel and Mechanical Upgrades Project [$28,113.55] for a total project cost of $412,923.55.  (Commission District 3.)

 

5.D.4.    Adopt a Resolution Accepting Real Property for Use as a Public Street (A portion of Official Plat of Woodland Village Phase 18, Subdivision Tract Map No. 5087, Outpost Court and portion of Village Parkway), APN 556-581-30 (totaling 61,768 square feet), for use as a public street right-of-way; and if approved, direct the Clerk’s Office to record the Resolution.  (Commission District 5.)

5.E.1.     Approve a 2015 Department of Homeland Security (DHS) State Homeland Security Program (SHSP) grant passed through the State of Nevada, Division of Emergency Management [$70,000; no match required] for a Continuity of Operations and Continuity of Government project; [$6,630] for non-county travel for attendance to Planning and Training events and [$2,780] in food purchases; retroactive from September 01, 2015 through August 31, 2017; and direct Comptroller’s Office to make the appropriate budget adjustments.  (All Commission Districts.)

 

5.E.2.     Approve a 2015 Department of Homeland Security (DHS) State Homeland Security Program (SHSP) grant passed through the State of Nevada, Division of Emergency Management [$99,979.45] for upgrades and sustainment to the existing Northern Nevada Radio Cache; retroactive from September 01, 2015 through August 31, 2017; and direct Comptroller’s Office to make the appropriate budget adjustments.  (All Commission Districts.)

 

5.E.3.     Approve a 2015 Department of Homeland Security (DHS) State Homeland Security Program (SHSP) grant passed through the State of Nevada, Division of Emergency Management [$100,000; no match required] for a Public Information/Public Warning project; retroactive from September 1, 2015 through August 31, 2017; and direct Comptroller’s Office to make the appropriate budget adjustments.  (All Commission Districts.)

5.E.6.     Approve recommendation for Commission District Special Fund grant for Fiscal Year 2015-2016 for Commission District 4 [not to exceed $16,000]; District 4 Commissioner Vaughn Hartung recommends grant expenditure to Truckee Meadows Fire Protection District in support of purchasing a Chest Compression System for Station 17.  (Commission Districts 4.)

5.F.1.     Approve a sub grant award [$44,973, no match required] from the Nevada Division of Emergency Management, FFY 2015, Project number 97067HL5, to the Washoe County Sheriff’s Office for the Citizen Corps Program. Grant term is retroactive from September 1, 2015 through August 31, 2017. If approved, direct Comptroller’s Office to make the necessary budget adjustments. (All Commission Districts.)

 

5.F.2.     Approve a sub grant award [$134,100, no match required] from the Nevada Division of Emergency Management, FFY 2015, Project number 97067HL5, to the Washoe County Sheriff’s Office for Cyber Security. Grant term is retroactive from September 1, 2015 through August 31, 2017 and if approved, direct Comptroller’s Office to make the necessary budget adjustments.  (All Commission Districts.)

 

5.F.3.     Approve Sheriff’s Security Agreement between the Hayfed LLC dba Ultra 4 Racing event and the Washoe County Sheriff’s Office to provide two uniformed Deputy Sheriffs [costs to be reimbursed by Hayfed LLC] and other various functions for the period of September 4, 2015 to December 31, 2015 at the Wild West Motorsports Park.  (Commission District 4.)

5.G.1.    Accept a Sub-grant Award from the State of Nevada Division of Child and Family Services in the amount of [$3,960; no County match required] to purchase portable cribs and sheets retroactive from July 1, 2015 through June 30, 2016; authorize the Department to execute the Sub-Grant Award and direct the Comptroller’s Office to make the necessary budget adjustments.  (All Commission Districts.)

 

5.G.2.    Accept a Sub-grant Award from the State of Nevada Division of Child and Family Services in the amount of [$99,500; no County match required] to support an adoption awareness campaign in collaboration with Wolf Pack Sports Properties, LLC retroactive to July 1, 2015 through June 30, 2016; authorize the Department to execute the Sub-Grant Award and direct Comptroller’s Office to make the necessary budget adjustments.  (All Commission Districts.)

10.        Recommendation to Award of Bid #2947-16 for Janitorial Services for Washoe County High Security Buildings to the lowest responsive and responsible bidder, Qual-Econ U.S.A., Inc, 1015 Telegraph Street, Suite C, Reno NV  89502, for sixteen (16) high security buildings in the amount of [$58,067, per month] subject to possible price reductions as negotiated by the Contracts Services Supervisor; and authorize the Purchasing and Contracts Manager to execute a two (2) year agreement with one (1) single year renewal option [estimated annual value $696,804 per year].  Comptroller.  (All Commission Districts.)

 

11.        Recommendation to approve a no-cost extension to the budget period to September 29, 2016 for a grant from the Federal Administration for Children and Families for the Permanency Innovations Initiative (PII) Program to prevent long-term foster care and approve a professional services agreement with The Children’s Cabinet, Inc. in the amount of [$475,000] to provide case management services retroactive to September 30, 2015 through June 30, 2016; and direct Comptroller’s Officer to make the appropriate budget adjustments.  Social Services.  (All Commission Districts.)

 

12.        Recommendation to approve a request to initiate proceedings to amend the Washoe County Code (Chapter 100 – Buildings and Construction) for review of current building permit fees in association with the potential impacts of the proposed regional technology fee; and direct the County Clerk to submit the request to the District Attorney for preparation of a proposed ordinance, pursuant to Washoe County Code Section 2.030 and 2.040.  Community Services.  (All Commission Districts.)

 

13.        Discussion and possible direction to the County Clerk to cause notice to be published and posted of an application by NV Energy, doing business as Sierra Pacific Power Company, (“NV Energy”) for a Franchise Agreement to provide electric service to portions of Washoe County and to set the date for a hearing on the application including any objections thereto for December 8, 2015.  Manager.  (All Commission Districts.)

 

14.        Discussion and possible direction to the County Clerk to cause notice to be published and posted of an application by NV Energy, doing business as Sierra Pacific Power Company, (“NV Energy”) for a Franchise Agreement to provide service and distribution of natural gas service to Washoe County and to set the date for a hearing on the application including any objections thereto for December 8, 2015.  Manager.  (All Commission Districts.)

 

15.        Update on Commissioner Requests submitted during Washoe County Board of County Commissioners meetings between January 1, 2015 and October 1, 2015.  Manager.  (All Commission Districts.)

 

The following items only (Agenda Items #16 thru #18) are introduction and first reading of an Ordinance. And, if supported, the public hearing for second reading and possible adoption of the Ordinance will be scheduled at a later meeting.

 

16.        Introduction and first reading of an ordinance amending the Washoe County Code at Chapter 110 (Development Code) within Article 306, Accessory Uses and Structures, at Section 110.306.10, Detached Accessory Structures, to clarify when a building permit is required for a cargo container; at Section 110.306.35, Outdoor Storage/Outdoor Display, for the definition of a commercial vehicle and for exceptions to commercial vehicle storage; within Article 310, Temporary Uses and Structures, at Section 110.310.35, Mobile Homes, Manufactured Homes, Travel Trailers, Commercial Coaches and Recreational Vehicles, to change the name of storage containers to cargo containers to match regulations within Article 306 and to refine regulations concerning temporary contractor or owner-builder portable containers; and, to update these sections within both Article 306 and Article 310 to reflect the current organization of the Community Services Department and the Health District’s name.  Recommendations include other matters properly relating thereto; and, if supported, set the public hearing for second reading and possible adoption of the Ordinance for October 27, 2015.  Community Services.  (All Commission Districts.)

 

17.        Introduction and first reading of an ordinance amending the Washoe County Code at Chapter 110 (Development Code) at Article 422, Water and Sewer Resource Requirements, and at Article 706 as follows:  To reflect changes required from the transfer of the water utility functions of the Washoe County Community Services Department to the Truckee Meadows Water Authority (TMWA);  To delete Sections 110.422.30, Contracts for Water Rights and Water Facilities, 110.422.10, Water Resources, and 110.706.10, Southeast Truckee Meadows Specific Plan Impact Fee, in their entirety;  To add a new Section 110.422.03, Definitions; To amend Section 110.422.00, Purpose, for water and sanitary resource requirements for development; To clarify in Section 110.422.01, Exceptions, that the resource requirements do not apply to the Tahoe Planning Area, areas within the TMWA service area, and to Developments within a General Improvement District (GID) which is receiving water and sanitary sewer service from said GID; To clarify in Section 110.422.05, Applicability, where within the County the resource requirements apply; To amend Sections 110.422.15, Water Rights Satisfaction, for resource requirements and water rights dedication or relinquishment requirements outside of TMWA’s service area; To remove administrative and service fee requirements from Section 110.422.20, Authority to Utilize Dedicated Water Rights and Collect Administrative Fees; To clarify in Section 110.422.25, Water Facilities, the procedures to offer for dedication and to operate water delivery facilities; and To update the Article with the current Community Services Department organization language and remove references to the Department of Water Resources, Utility Services Division.  Recommendations include other matters properly relating thereto, and, if supported, set the public hearing for second reading and possible adoption of the Ordinance for October 27, 2015.  Community Services.  (All Commission Districts.)

 

18.        Introduction and first reading of an Ordinance amending Washoe County Code Chapter 55 by  repealing provisions containing metes and bounds descriptions of animal congested areas; by amending provisions related to reporting violations of animal statutes, restraining animals, licensing dogs, rabies vaccinations, “at large” domestic animals, impounded animals and quarantine; and by repealing, adding and revising various definitions.  Set the public hearing for second reading and possible adoption of the ordinance on November 10, 2015.  Animal Services.  (All Commission Districts.)

 

19.        Public Hearing for second reading and possible adoption of an ordinance amending the Washoe County Code (Chapter 60 – Fire Code) to adopt a new Section 5601.1.6 within the International Fire Code Chapter 56: Explosives, of Washoe County Code Chapter 60 containing provisions that amend the 2012 Edition of the International Fire Code.  Truckee Meadows Fire Protection District.

 

20.        Possible Closed Session for the purpose of discussing labor negotiations with Washoe County, Truckee Meadows Fire Protection District and/or Sierra Fire Protection District per NRS 288.220.
